1. General Provisions

1.1.
These general terms and conditions of sale (hereinafter, “General Conditions”) govern all sales of DAG Style products (hereinafter, “Products” or “Product”) concluded remotely via the website www.dagstyle.it (hereinafter, the “Website”).

1.2.
The remote sales service governed by these General Conditions is exclusively reserved for consumers (hereinafter, “Customers” or “Customer”); "consumers" are defined as natural persons over 18 years of age who act for purposes unrelated to their commercial, entrepreneurial, artisanal, or professional activity.

1.3.
The language used for the conclusion of sales contracts through the Website is Italian.

1.4.
By concluding the sales contracts, the Customer accepts and agrees to comply with these General Conditions.
Customers are therefore required to carefully read the General Conditions, available on the Website, to be aware of them, store them, and reproduce them. DAG Style will provide the Customer with a copy of the General Conditions pursuant to article 5.10 of these General Conditions. Contracts concluded with Customers will be stored by DAG Style for the period required by current regulations.

2. Seller Identification

2.1.
The seller is DAG Style s.r.l., with registered office at Via Manzoni No. 18, Flero (BS), Italy. VAT number 02795680988, tax code 02795680988, REA BS-479109, share capital of €100,000.00 fully paid ("DAG Style").

3. Product Information and Availability

3.1.
Product information, along with Product codes and prices, is clearly available on the Website.

3.2.
The Products available on the Website represent a selection of the items normally available in stores; however, DAG Style does not guarantee that the Products available on the Website are also available in stores. The graphical representation of the Products on the Website may differ from reality; therefore, the Customer must rely solely on the Product description and characteristics listed on the Website.

3.3.
DAG Style reserves the right to limit, at any time, the quantity and/or type of Products available for purchase on the Website. The style, models, and colors of the Products described on the Website may be changed without notice. During the purchase process, if it is not possible to fulfill the order due to unavailability of the ordered Product, the Customer will be informed via an automatic message. DAG Style cannot in any case be held liable towards the Customer for the unavailability of a Product.

3.4.
DAG Style is not liable for any errors resulting from the Customer’s connection failure to the Website.

4. Price

4.1.
The price of the Products indicated on the Website is expressed in Euros and excludes all applicable taxes or duties. Delivery charges must be added to the Product prices and are clearly highlighted in the order form.

4.2.
DAG Style constantly checks the accuracy of the prices shown on the Website; however, it cannot guarantee the absence of errors. If an error in the price indication of a Product is found, DAG Style will reject the order and offer the Customer the opportunity to purchase the Product at the correct price.

5. Conclusion of the Contract

5.1.
The Website displays the essential characteristics and the price of each Product. The information provided on the Website does not constitute an offer by DAG Style.

5.2.
Before submitting an order proposal through the Website, the Customer must carefully read all the instructions provided during the purchase process (including delivery charges, the conditions for exercising the right of withdrawal, and the Privacy Policy), as well as these General Conditions.

5.3.
To purchase a Product, the Customer must (I) add the selected Product to the “Cart” by clicking the appropriate button, (II) fill out the order proposal, (III) select the payment method, (IV) accept the General Conditions, and (V) submit the order proposal to DAG Style via the Website.

5.4.
Submitting the order proposal constitutes a contractual purchase offer for the selected Product and implies full knowledge and full acceptance of these General Conditions. Submitting the order proposal also entails the Customer's obligation to pay for the ordered Product(s).

5.5.
Before submitting the order proposal, the Customer can correct or modify the entered data by following the procedure indicated on the Website (for example, the Customer can change the quantity of Products intended for purchase by adding or removing Products from the “Cart”).

5.6.
Without prejudice to the use of personal data as described in the Privacy Policy, the form containing the order proposal and the Customer's data related to the order may be kept by DAG Style for the time required by applicable regulations.

5.7.
The contract between DAG Style and the Customer is concluded when the Customer receives confirmation from DAG Style that the order proposal has been accepted via the procedure provided on the Website. Acceptance (or refusal) by DAG Style of the order proposal will be sent to the Customer’s email address provided in the order proposal (“Order Confirmation”).

5.8.
DAG Style may refuse an order proposal (in which case no amount will be due from the Customer to DAG Style, except possibly as indicated in article 6) in the following cases:

  • (I) if the Products are unavailable (subject to articles 3.3 and 5.9);

  • (II) if the Customer’s payment is unsuccessful (e.g., credit card charge failure or missing bank transfer confirmation within 10 business days from the order proposal date);

  • (III) if there are reports or suspicions of fraudulent or illegal activities;

  • (IV) if the Customer has not fulfilled obligations arising from a previous contract with DAG Style.

5.9.
In case of unavailability of one or more ordered Products, the Customer will be notified by email. In such a case, the order proposal will be canceled or accepted only for the available Products. In case of partial acceptance, the Customer will only pay for the available Products.

5.10.
In accordance with article 51, paragraph 7 of the Consumer Code, the Order Confirmation will include a summary of the essential characteristics of the purchased Products, detailed price information, payment methods, delivery costs, the conditions and methods for exercising the right of withdrawal (including exclusion in the case of customized Products), a complaint address, post-sales support information, and warranty conditions. The email confirming shipment of the Products ("Shipping Confirmation") will also include a copy of these General Conditions.

5.11.
The risk of loss or damage to the Products transfers to the Customer at the moment the Customer (or a third party designated by the Customer and different from the carrier) physically receives the Product.

6. Payment Methods

6.1.
The Customer may pay for the Products listed in the order proposal and for the shipping costs by credit card or bank transfer or paypal.

6.2.
Accepted credit cards are:

  • Visa;

  • MasterCard.

6.3.
The Customer’s credit card will only be charged after:

  • (I) the card details have been verified;

  • (II) authorization to debit has been received from the card issuer;

  • (III) Product availability has been confirmed by DAG Style.

6.4.
No charge will be made at the time of submitting the order proposal, except for a temporary authorization that may be needed to verify the validity of the card. This temporary authorization will be canceled after the order is fulfilled or if the order is canceled.

6.5.

6.6.
If the amounts due cannot be charged to the credit card or transferred via bank transfer within 10 (ten) business days from the order date, the contract will not be executed and the order will be canceled.

7. Shipping and Delivery

7.1.
Products will be delivered to the address indicated by the Customer in the order proposal. A signature from the Customer (or their delegate) is required upon delivery. Deliveries to P.O. boxes are not permitted.

7.2.
In the case of payment by bank transfer, shipments will only be made after receipt of the transfer by DAG Style.

7.3.
For each order, DAG Style will issue an invoice, sent to the Customer by email or postal mail according to applicable law, based on the information provided during the order. Changes to the invoice after issuance are not permitted.

7.4.
Delivery costs are the Customer’s responsibility and are separately highlighted in the order form.

7.5.
Products will be delivered via a courier selected by DAG Style ("Courier") from Monday to Saturday (Saturday delivery is available only where selected). Deliveries are excluded on Sundays and national or local holidays.
Deliveries will be made within 30 (thirty) days from the date of the Order Confirmation (unless force majeure or unforeseeable circumstances occur).
Important Note: No liability will be attributed to DAG Style in case of delivery delays. Events of force majeure, transport unavailability, or unforeseen events may give DAG Style the right to split, delay, or cancel deliveries, in whole or in part, or to terminate the contract. The Customer will only be entitled to a refund of any amount already paid.

7.6.
Upon delivery, the Customer (or delegate) must verify:

  • (I) that the number of packages matches the delivery note;

  • (II) that the packaging and seals are intact and not damaged or altered.

Any anomalies must be immediately reported on the Courier’s delivery note.
After signing without objections, the Customer may no longer raise complaints about the external appearance of the delivered package.

8. Confirmation of Shipment and Delivery

8.1.
DAG Style will send the Customer an email confirming the shipment of the Products, and a second email confirming the delivery.

9. Packaging

9.1.
Products purchased through the Website are delivered using the same packaging normally used in DAG Style stores.

10. Right of Withdrawal

10.1.
According to Article 52 of the Consumer Code, the Customer has the right to withdraw from the contract, without reason, within 14 (fourteen) days from when the Customer (or an authorized representative) physically receives the Product.

10.2.
To exercise the right of withdrawal, the Customer must send an email (to [email protected]) or postal mail (to DAG Style s.r.l., Via Manzoni 18, 25020 Flero (BS) – Italy), within the above deadline:

  • (I) the attached withdrawal form, duly completed and signed; or

  • (II) a communication clearly expressing the intention to exercise the right of withdrawal, including: (I) identification of the Product, (II) order number, and (III) IBAN code if the purchase was paid by bank transfer.

10.3.
Within 14 (fourteen) days after the withdrawal communication, the Customer must return the Product to DAG Style at the following address: DAG Style, Via Manzoni 18, 25020 Flero (BS), Italy.
Return shipping costs are borne by the Customer unless otherwise communicated.
The Customer is responsible for any diminished value of the Product due to handling beyond what is necessary to establish its nature, characteristics, and functioning.

10.4.
DAG Style will reimburse the Customer the full amount paid (or part of it in the case of partial withdrawal), including reasonable delivery costs, without undue delay and no later than 14 (fourteen) days after being informed of the withdrawal.

10.5.
DAG Style may withhold reimbursement until it has received the returned Product or proof of return from the Customer.

10.6.
Products can also be returned at DAG Style directly managed stores, excluding outlets, corners, franchises, and duty-free shops. No cash refunds are available at stores.

10.7.
Once the Product has been shipped, the order cannot be canceled or modified; returns must be made following the procedure described above.

11. Customized Products

11.1.
According to Article 59, paragraph 1, letter c) of the Consumer Code, the right of withdrawal does not apply to customized Products (e.g., items engraved with the Customer’s initials).

12. Product Replacement

12.1.
Without prejudice to Customer rights under Articles 10 and 13, DAG Style offers the possibility to replace Products following this procedure:

  • (I) Contact DAG Style by email ([email protected]) upon receiving the Product;

  • (II) Indicate the reason for the replacement request and the code of the new Product desired;

  • (III) Return the Product within 14 (fourteen) days from delivery, with original tags intact, at the Customer’s expense;

  • (IV) DAG Style will reimburse the amount paid by the Customer within 14 (fourteen) days from the returned Product's delivery;

  • (V) DAG Style will confirm replacement depending on the new Product’s availability.

12.2.
The replacement will be processed as a new order under the same conditions as the original order.

13. Conformity Defects

13.1.
Products sold on the Website comply with Italian and EU law.
If a Product sold by DAG Style shows a manufacturing defect or a conformity defect, the Customer must promptly contact DAG Style via email or post:

13.2.
Products are covered by the legal warranties provided under Articles 129, 130, and 132 of the Consumer Code.
The Customer has the right to repair or replacement of the Product at no cost, or, if these remedies fail, a price reduction or contract termination.
Defects must be reported within 2 (two) months from discovery; claims expire within 26 (twenty-six) months from delivery.

13.3.
If the Customer requests repair or replacement, the related shipping costs are borne by DAG Style.

14. Authenticity Guarantee and Intellectual Property Rights

14.1.
DAG Style guarantees the authenticity of all Products purchased on the Website.
DAG Style Products are made with Italian materials by Italian craftsmen, and are fully MADE IN ITALY.

14.2.
The "DAG Style" trademark and all related logos, images, and other intellectual property rights are the exclusive property of DAG Style s.r.l. and/or its licensors.
Any use of such materials without prior written authorization is prohibited.

15. Applicable Law and Jurisdiction

15.1.
These General Conditions and contracts concluded with Customers are governed by Italian law, including Legislative Decree No. 206 of September 6, 2005 ("Consumer Code") and Legislative Decree No. 70 of April 9, 2003 ("E-commerce Decree").

15.2.
Any disputes will be referred to the exclusive jurisdiction of the court of the Customer’s place of residence or domicile.
